Abstract

The high incidence of sexual abuse of minors in China and the extent of the problem requires an urgent response from the legal system. Based on the analysis of the theoretical basis and the realistic needs, through the review of the relevant Chinese legislation, it is pointed out that the system suffers from three major difficulties: the lack of a basis in the higher law and its contradiction with the higher law, the possible conflict with the protection of the offender's right to privacy and the imperfect supporting mechanism. The system should be improved from three perspectives.
