Thinking Based on The Understanding and Application of Judicial Interpretation in The Trial of Urban Housing Lease Contract Dispute Cases

Abstract

Since the 21st century, the cost of developing commercial housing has been increasing, an d the rise of real estate investment wave has heated up the real estate market. At the same time, the government also introduced a number of favorable policies to accelerate the flourishing growt h of the real estate industry. Under this background, housing prices are starting to rise rapidly, faced with high housing prices, many people began to turn to the rental market. There are many contradictions and disputes between the parties when carrying out house rental market. Facing this emerging industry, other interpretations have been formulated outside the Civil Code in our cou ntry in order to protect and mediate the legitimate rights and disputes of the parties. In this paper, the lease contract and some basic terms are explained, through the analysis and discussion of some problems encountered in practice and the interpretation of the specific law, to find the existi ng disputes and loopholes in the specific law. The law promulgated in 2009 has made effective provisions on the specific disputes of house rental decoration, but its interpretation still has some deficiencies and ambiguities. In this paper, some practical cases are combined to reflect and refute the deficiencies in its interpretation and put forward some feasible suggestions.
